The city of Phoenix aviation department has filed a formal complaint in Maricopa County Superior Court stating that Tempe has violated a contract dating back to 1994.
This follows discussions between Phoenix and Tempe over the past year to resolve disagreements and find a path forward without litigation.
Per Phoenix Aviation Department Director of Aviation Services, Chad Makovsky,
The Phoenix Aviation Department does not object to a sports arena, restaurants, shops, and other compatible uses related too the proposed Tempe Entertainment District. Today's action is about ensuring Tempe lives up to its commitments to protecting our state's largest economic engine - Phoenix Sky Harbor International Airport, the more than 57,000 employees and 44 million annual travelers who depend on the Airport, and the communities surrounding the Airport who depend on the long-standing agreement between our two cities.
This lawsuit could derail the project's intent to have apartment complexes in the district, although right across from the proposed site there are apartments presently. The city of Phoenix seems to also be against adding another entertainment venue to compete with Footprint Center Arena where the Phoenix Suns play NBA basketball and numerous concerts take place.
The city of Tempe has scheduled a vote with three propositions on the project for May 16th. The fate of the Arizona Coyotes future arena plans are in the hands of Tempe voters.
Per Coyotes insider Craig Morgan of GOPHNX.com:

Needless to say, with this happening in conjunction with the minority owner Andrew Barroway's arrest recently for felony strangulation, the Coyotes franchise seems to have many challenges to overcome.
Relocation chatter has already begun AGAIN !
